1. Who you’re contracting with
FlexYin is provided by Brain Boogerz, LLC (“Brain Boogerz,” “we,” “us,” or “our”). By creating an account, purchasing a membership or session, or continuing to use FlexYin, you agree to these Terms. If you use FlexYin for an organization, you confirm you have authority to bind it.
2. What FlexYin provides
FlexYin provides fitness-program planning, workout and nutrition tracking, meal-planning tools, body-composition visualization, recovery guidance, reflective mental-health check-ins, coach messaging, and optional coaching sessions. A paid membership gives you a limited, personal, non-exclusive, non-transferable right to use the service while your membership is active.
FlexYin is educational and informational. It does not provide medical diagnosis, treatment, psychotherapy, or emergency services. Nutrition and body projections are estimates, not guarantees. Consult a qualified professional before acting on guidance when you have an injury, health condition, pregnancy, medication concern, or eating-disorder history.
3. Accounts and accurate information
You must be legally able to enter this agreement. Keep your credentials confidential and give us accurate, current information. You are responsible for activity under your account and for deciding whether recommendations are appropriate for you.
4. Acceptable use
Do not use FlexYin for unlawful activity, fraud, spam, harassment, intellectual-property infringement, malware, security probing, automated scraping, reverse engineering, resale, redistribution, or circumvention of service limits. Do not upload content you do not have the right to use. Photos must follow our standard: posing trunks, shorts, a sports bra, or fitted athletic wear — never nude.
5. Your content
You keep your rights in information, photos, messages, and other content you submit. You give Brain Boogerz, LLC a limited licence to host, process, display, and transmit that content only as needed to operate and improve FlexYin. You are responsible for your content and may report suspected rights violations through the support channel available in the app. We may remove infringing or unsafe content and restrict repeat offenders.
6. Our intellectual property
Brain Boogerz, LLC owns FlexYin’s software, documentation, training framework, visual design, branding, and other service materials. These Terms do not transfer those rights to you.
7. Payments, billing, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, renewal, cancellation, and refund mechanics are governed by Paddle’s Buyer Terms together with our Refund Policy. Memberships renew monthly until cancelled. You may cancel anytime through the payment-management tools provided in FlexYin; access ends when the cancellation takes effect under the plan shown at checkout.
8. Availability and changes
We work to keep FlexYin available, but do not guarantee uninterrupted, secure, or error-free performance. We may change, suspend, or discontinue features when reasonably necessary. We may update these Terms and will post the new effective date here.
9. Suspension and termination
We may suspend or terminate access for a material breach, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, service features may stop immediately. We may retain or delete data as described in our Privacy Notice and as required by law.
10. Warranties and liability
To the fullest extent permitted by law, FlexYin is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Brain Boogerz, LLC is not liable for indirect, special, incidental, or consequential losses. Our aggregate liability relating to the service will not exceed the fees you paid us in the six months before the event giving rise to the claim. Nothing here excludes liability that cannot legally be excluded, including liability for fraud, death, or personal injury caused by negligence where applicable.
11. Your responsibility to us
You agree to indemnify Brain Boogerz, LLC against third-party claims resulting from your unlawful use, your content, or your material violation of these Terms, to the extent permitted by law.
12. General terms
You may not assign this agreement without our consent. We may assign it in connection with a merger, acquisition, reorganization, or sale. Neither party is responsible for delay caused by events beyond reasonable control. If one provision is unenforceable, the rest remain in effect.
